I have a desktop with XP Home Edition I now have a Laptop can I legally use Home edition on both machines. After all I wont be using them both at the same time.

You cant legally use it.
You need a licence for each installation, you can't "share" a licence.

As XP will need to be "activated" after install, the activation should fail on the second installation, as it will be recognised by Microsoft (who control the activation process) as being already installed on a different machine.

This means that after a few days it will cease to operate on the second installation.

Godfather, I had a feeling the XP activation would allow for TWO installs, so that people could install on their desktop and laptop (as long as they weren't using both at the same time)??? Or was this something from a few years ago with Office (when they first started with their stupid activation thing)???

You are confusing Windows Operating Systems with Microsoft Office?

A full version of MS Office allows it.

Operating Systems have never allowed it.
